Der Gegensatz ist weniger in europäisch-nichteuropäisch oder industrialisiert-nichtindustrialisiert zu sehen, sondern (natürlich auf der eurozentrischen Grundlage des Kolonialismus) in christlich-nichtchristlich. *
Das völkerrechtliche Verständnis bezog auf dieser Grundlage neben den Europäischen Kolonialmächten die USA gleichwertig ein. Die postkoloniale USA schuf hier insoweit auch keine Sonderrechte bzw. eigenständige Rechtsentwicklungen, sondern trat in die europäische Tradition ein. Folgerichtig ist das rechtliche Verständnis nicht speziell auf die Amerindians ausgerichtet, sondern in entsprechender Weise auf Afrika und Asien angewendet worden (lediglich ausserhalb des US-Blickwinkels).
Völkerrecht und vertragsrechtliche Betrachtungen** sind zu trennen. Das mag schwerfallen, wie man andeutungsweise den Beiträgen entnehmen kann, da hier eine Rechtsentwicklung über 100 Jahre stattgefunden hat, in denen sich der US-Rechtsraum bis zur Pazifikküste ausgedehnt hat. Um das zeitlich zu sortieren:
1. Discovery-Doctrine: Johnson ./. MacIntosh
Die Übernahme des bis dato eurozentrischen Ius Gentium: "premised on the ancient principle of Christian Dominion and a distinction between paramount rights of 'christian people' and subordinate rights of 'heathens' or non-Christians." (Newcombe/Williams). Die gewaltsame Landnahme von "non-Christians" als Quelle von Souveränität und territorialer Staatlichkeit ist zulässig. Hier liegt die Quelle, weitere Landnahme abgeschlossenen Verträgen überzuordnen:
"On the discovery of this immense continent, the great nations of Europe were eager to appropriate to themselves so much of it as they could respectively acquire. Its vast extent offered an ample field to the ambition and enterprise of all, and the character and religion of its inhabitants afforded an apology for considering them as a people over whom the superior genius of Europe might claim an ascendency. The potentates of the old world found no difficulty in convincing themselves that they made ample compensation to the inhabitants of the new by bestowing on them civilization and Christianity in exchange for unlimited independence. But as they were all in pursuit of nearly the same object, it was necessary, in order to avoid conflicting settlements and consequent war with each other, to establish a principle which all should acknowledge as the law by which the right of acquisition, which they all asserted should be regulated as between themselves. This principle was that discovery gave title to the government by whose subjects or by whose authority it was made against all other European governments, which title might be consummated by possession."

2. Dokrtin der Domestic Dependent Nations: Cherokee Nation ./. Georgia
Hier ging es um die Geltendmachung von Vertragsrechten der Cherokees, die diese als separate Nation gegenüber Georgia geltend machen wollen. Hier findet man den staatlichen "override" der gesondert vereinbarten "treaties":
"They may more correctly, perhaps, be denominated domestic dependent nations. They occupy a territory to which we assert a title independent of their will, which must take effect in point of possession when their right of possession ceases; meanwhile, they are in a state of pupilage. Their relations to the United States resemble that of a ward to his guardian. They look to our Government for protection, rely upon its kindness and its power, appeal to it for relief to their wants, and address the President as their Great Father."

3. Plenary-Power-Doktrin: Cherokee-Tobacco-Case
Hier geht die eigenständige Betrachtungsweise der USA für die Landnahme weiter, auf Basis der veränderten Sachlage und territorialen Ausweitung, sozusagen der Schlusspunkt aus der Wurzel unter 1.
"This Constitution and the laws of the United States which shall be made in pursuance thereof, and all treaties which shall be made under the authority of the United States, shall be the supreme law of the land.
It need hardly be said that a treaty cannot change the Constitution or be held valid if it be in violation of that instrument. This results from the nature and fundamental principles of our government. The effect of treaties and acts of Congress, when in conflict, is not settled by the Constitution. But the question is not involved in any doubt as to its proper solution. A treaty may supersede a prior act of Congress, and an act of Congress may supersede a prior treaty. In the cases referred to, these principles were applied to treaties with foreign nations. Treaties with Indian nations within the jurisdiction of the United States, whatever considerations of humanity and good faith may be involved and require their faithful and good faith may be inobligatory. They have no higher sanctity, and no greater inviolability or immunity from legislative invasion can be claimed for them. The consequences in all such cases give rise to questions which must be met by the political department of the government. They are beyond the sphere of judicial cognizance. In the case under consideration, the act of Congress must prevail as if the treaty were not an element to be considered. If a wrong has been done, the power of redress is with Congress, not with the judiciary, and that body, upon being applied to, it is to be presumed, will promptly give the proper relief."

Die Entwicklung war noch nicht abgeschlossen. Im Ex-Parte-Crow-Dog-Fall hatte der Supreme Court die Anwendung von US-Strafgesetzen in indianischen Reservaten abgelehnt. Der Kongress
überlagerte dieses sofort mittels des Major Crimes Act 1885, der dann durch den Kagama-Case der gerichtlichen Überprüfung unterzogen wurde.

Die Rechtsentwicklung geht noch weiter, was aber hier nicht interessiert. Entscheidend ist die Überlagerung von Verträgen durch späteres staatliches Recht (oben als "Vertragsbruch" bezeichnet) und die Wurzeln dieses Verständnisses.
Dementsprechend trifft dieses:
Man verhandelte wenigstens offiziell in der Regel von gleich zu gleich, jedenfalls bis 1871 der Kongress der Regierung den Abschluß von Verträgen verbot.
...nicht den Kern des (völkerrechtlichen) Problems. Für den Nichtabschluss von Verträgen ist keine weitergehende Begründung wichtig, das ist staatliche Willensbildung. Das rechtstheoretische Problem lag vielmehr in der Frage der Fortgeltung der bereits abgeschlossenen Verträge, siehe oben.
4. Indian Appropriations Act 1851/1871, Kagama-Case und Lone Wolf ./. Hitchcock

Zu dem Zeitpunkt waren über 400 Verträge abgeschlossen, für die Lone Wolf ./. Hitchcock konstatierte:
"The power exists to abrogate the provisions of an Indian treaty, though presumably such power will be exercised only when circumstances arise which will not only justify the government in disregarding the stipulations of the treaty, but may demand, in the interest of the country and the Indians themselves, that it should do so. When, therefore, treaties were entered into between the United States and a tribe of Indians it was never doubted that the power to abrogate existed in Congress, and that in a contingency such power might be availed of from considerations of governmental policy, particularly if consistent with perfect good faith towards the Indians. "

So gesehen, bestehen hier auf Grundlage der Discovery-Doctrine 400 Anwendungsfälle für Aufhebungen.*** Vielleicht ist nun die Komplexität etwas deutlicher geworden, und der Fluss der Rechtsentwicklung. Wenn also die Discovery-Doctrine bzw. die Landnahmetheorie nicht in Kagama oder Lone Wolf auftaucht, und man hier vergeblich Urteilsgründungen (bzw. Gesetzesbegründungen) durchforstet, heißt das nicht, dass diese völkerrechtliche Basis des Vertrags-Verständnisses keine Rolle spielte.
